Kim Byrne, Secretary presented minutes from the August 13, 2016 monthly meeting. The minutes were approved as written.

Treasurers Report:

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written.

Aquatic Life:

Lily pads were sprayed this past Wednesday. Phyllis and Al Vitous assisted the spotter to be certain that all areas were treated. There was a 40’X40’ area sprayed in North Bay. Ornamentals were not sprayed.

The island has re-surfaced, and broken apart. It is not known if this is a natural process or if it has been hit by watercraft.

Roger has emailed and spoken to Brad Smith regarding key holing. Brad Smith indicated that because there is no zoning in Camden Township, the township has no power to intercede. Dan Fleck commented that he had gathered information, then presented it to Brad Smith approximately four years ago. Roger will speak to Roy Brandes, then follow-up with Brad Smith.

Building Committee:

There has been a complaint filed with Hillsdale County for the remaining eight property owners whom are non-compliant with the removal of their camping trailers. The defendants have twenty-one days to respond or move their trailers. Because the attorney filed one complaint, but included all eight property owners, the cost was just $175.00.

Roger proposed paying legal fees for “co-signees” of trailer lawsuit(s). It is possible that a neighbor could be a co-signee on a trailer lawsuit, then face future legal fees due to retribution from the original suit. There are multiple variables to this type of situation. The proposal was tabled. There will be further discussion in the future.

Scott Preston applied for and received authorization from the Building Committee to construct a storage barn on his lot adjacent to his house. He also filed a “Combination Request Form” with Amboy Township to combine his two lots. His request was denied as his two lots are in different subdivisions. The board agreed to assist Scott in resolving the issue. Kim Byrne will email a copy of the Resolution of Variances along with a sample of a granted variance to Scott for reference.

Approval was granted to Karen and Jim Watt for revision and extension of their home at 1866 Anchor Way.

Approval was granted to John and Jane Imo to construct a storage barn. This would require that they relocate their existing structure property lot line to accommodate space for the storage barn. The Imo’s hold title to the adjoining lot. They have filed for, and received permission to relocate the lot line with Amboy Township. Verbal approval was conveyed to the Building Committee from Amboy Township via the Imo’s. However, the building committee does not have the approval in hand. Dan Fleck was present, and indicated he plans to file suit with both the township and the Imo’s citing a violation in procedure.

Dredging:

Scott Coakley has dedicated time to study the lake, and its areas which need dredging. The areas will need to be prioritized. Scott proposes organizing a committee, as the process takes much time and effort. Bob Christ asked if the lake level could be raised. Scott indicated that he has inspected the dam, and indeed the lake level could be raised approximately four inches. He will make contact with the necessary officials for permission to adjust the dam to raise the lake level.

Parks:

The shoreline restoration has begun. A report was given.

Welcome Committee:

There were four property closings this month. Al has completed fifteen new packets for future property owners.

Lake Diane Events:

The Toys for Tots Breakfast with Santa event is the final event of the year. Kim Byrne plans to speak with Kim at Shore Side Plaza to possibly move the event there to promote attendance.

Old Business:

Jerry Agrusa is working to pursue past due accounts. He has requested the top five delinquent accounts to proceed with collections.

New Business:

Jo Ellen & Gary Wright and Donna Davidson were in attendance to report the success of the Wine Crawl. This year’s event netted $4,000.00. The proceeds benefit Chickadee Park. There will be an addition to the existing play structure along with repairs to the original structure. Kevin Mack asked that a new infant swing seat be ordered for the equipment at the shelter house. Jo Ellen, Gary and Donna agreed to do so.

At 11:15AM, Roger made a motion that the meeting be adjourned. Jerry seconded the motion. A vote was taken, and the meeting adjourned.

Treasurers Report:

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written.

Aquatic Life:

Nothing new to report.

Building:

Approval was granted to John Gadwood of 14320 Tyson Trail to construct a storage barn on lot #21 Timber Ridge by the building committee. This is a non-member lot, and plans were submitted to the building committee as a courtesy. Ruth Weiss questioned if the building committee/association could be subjecting themselves to a lawsuit by reviewing and approving plans for non-member lots.

Approval was granted to Gary Dayton of 2172 Mindy Lane for construction of a house with attached garage.

Dredging:

Nothing new to report.

Parks:

Jo Ellen Wright asked if the slide at Chickadee Park was ready for repair. Kevin indicated that he has ordered the parts.

Jody Yoder asked who owns the lot next to Rick Willard. The location is home to a garden and miscellaneous “stuff”. Kevin explained that Lake Diane Property Owners Association owns the lot, and it is technically a park lot which lends itself to use by all members of the association.

Welcome Committee:

Nothing new to report.

Lake Diane Schedule of Events:

The Toys for Tots Breakfast with Santa Event is scheduled as planned. This year the event will be held at Shore Side Plaza as a means to increase visibility.

Kim Byrne is promoting sales of Lake Diane Sprit Wear. Please refer to lakediane.org for the order form.

Old Business:

There were five cases filed to small claims court for non-payment of dues. Of the five cases filed, two defendants have chosen to move their case(s) to district court, one defendant paid, one defendant signed an affidavit with a promise to pay, and one defendant is deceased. Jerry will follow-up with the deceased defendants widow to pursue collection.

New Business:

Jody Yoder and John Kay were in attendance to address the situation with the beavers building dens on the park lot near their properties. They have initiated a resolution to the problem, and came to the board for approval. “Wall Hangers” of Reading Michigan will assess the beaver den, then monitor and trap the beavers for a fee of $150.00. After discussion, Kim Byrne made a motion to approve funds for removal of the beavers on the park lot. Jim Watt seconded the motion. A vote was taken, and the motion passed unanimously.

Terry Rupp proposed adding larger rocks to stabilize the shoreline in the spring at an estimate of $800. Jim indicated that funds are available in the park budget. The board agreed to purchase the rocks now, then encourage volunteers to participate in placement in the spring.

Jim Watt presented a letter from the association insurance carrier requesting that there be “ground protection” placed under the large slide and swings at the shelter house park. It was decided that a uniform four inches of sand be placed in said area.

At 10:59AM, Al made a motion that the meeting be adjourned. Jim seconded the motion. A vote was taken, and the meeting adjourned.

Kim Byrne, Secretary presented minutes from the July 9, 2016 monthly meeting. The minutes were approved as written.

 

Treasurers Report:

 

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written. 

 

Today’s meeting has been designated primarily to address the concerns surrounding the violation of subdivision deed restrictions with placement and storage of RVs, i.e. campers, motor homes, and travel trailers by property owners with deed restrictions recorded with their property deeds. The decision to designate this meeting for discussion of RVs came after the high member and non-member attendance at the July 9, 2016 monthly board meeting.  Notices were broadcast via email, the Lake Diane Facebook page, and hard copy encouraging members and non-members to attend today’s meeting.  There were also signatures obtained from members whom were unable to attend today’s meeting supporting the Lake Diane Property Owners Association Board of Trustees efforts in moving forward with enforcement of the removal of RVs from deed restricted lots.  Members in attendance voiced both their support and opposition of the enforcement of the removal of RVs.  Roger circulated photos to the attendees of properties at Nettle Lake with RVs placed for storage and use to reinforce the potential consequences of neglecting to enforce deed restrictions regarding use and storage of trailers.  

 

Pam Hill proposed a motion to hold a special meeting to discuss the RV issue, and the potential for revision of individual subdivision deed restrictions. Pam was advised that she must have not less than 5% of the member’s signatures supporting the request, then submit the motion to a trustee of the board.

 

Susan Miller presented a letter to the board voicing concern and dissatisfaction with member’s and non-member’s use of their lots. She encouraged all property owners to comply with their deed restrictions to preserve “our neighborhood and property values.”

 

Roger informed attendees that the board will continue to pursue property owners with RVs placed on their deed restricted lot(s). It is the opinion of Roy Brandes, Lake Diane Property Owners Association attorney, that consent judgment dated June 9, 1989 has defined the phrase “no trailer and temporary structure shall be used or stored within a subdivision” to be limited to RVs, and that the subdivision deed restrictions are enforceable.

 

At 11:55AM, Roger made a motion that the meeting be adjourned.   Jim seconded the motion.  A vote was taken, and the meeting adjourned.

Treasurers Report:

 

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written. 

 

Aquatic Life:

 

This year there were two treatments of the lake weeds. The first treatment was not as effective as it should have been.  There were samples of the milfoil taken, and it has been determined that there are two different types.  They are cross breeding and becoming resistant to the chemicals that have been effective in the past.  There is a new chemical now being used.  The cost of the weed treatment has increased substantially.  This is due to the fact that the area that is being treated has nearly doubled in size. The lily pads will be treated in the fall, which is customary.

 

There have been two “No Wake” signs placed.

 

Building Committee:

 

Approval has been granted to Craig Martin of 2410 Mindy Lane to resurface his current deck and also enlarge it. Approval was also given to Randy & Kelly Stuckey of 2159 Mindy Lane to add a metal roof to their deck along with replace the current roof of the house with metal roofing.

 

There were members in attendance to discuss the board’s enforcement of removal of travel trailer’s and rv’s from their properties. Members are upset because the deed restrictions for all the subdivisions are outdated, and they wish to be able to store and use their travel trailer’s and rv’s at their own discretion, which puts them in violation.  A lengthy discussion ensued.  Up for discussion at the next monthly meeting will be the potential for revising the deed restrictions for each subdivision along with allowing the use and storage of travel trailers and rv’s.  Roger made a motion that all action which is currently being taken against members with travel trailers and rv’s on their properties cease until the August 13th monthly board meeting has taken place.  Jerry seconded the motion.  A vote was taken, and the motion passed unanimously.

 

 

Dredging:

 

Trustee, Scott Coakley is studying information that has been gathered to date for the dredging project(s). He will continue to research, then he will bring his findings to the board for discussion.

 

Parks:

 

Terry Rupp is looking for volunteers to help with the shoreline restoration project. Please contact Terry is you are available to help.

 

Welcome Committee:

 

Nothing new to report.

 

Lake Diane Events:

 

The jump house has been ordered for the family picnic. Jerry Agrusa is chairing the event, and is in need of volunteers to help with set-up, activities, and clean-up.

 

The golf outing is scheduled for July 30 at Windwood Hollow. There has been a great response with many teams signing up.

 

Old Business:

 

Jerry Agrusa is working to pursue past due accounts. At most, five accounts can be filed with small claims court at a given time.  The five with the largest outstanding balance will be pursued first.  The court has advised it takes six weeks for letters to be sent to defendants.

 

New Business:

 

Ray Neely has gathered information regarding the legal use of golf carts on public roads. At present time, the DNR is requiring all golf carts to have ORV permits.  The township supervisor has the ability to give consideration, then overturn the requirement. This information will be handed off to the township supervisor for consideration, then discussed at the next monthly meeting.

Treasurers Report:

Aquatic Life:

 

The goose egg round-up was a success. There were fifty-four eggs collected the first day, and zero eggs collected the second.  Kim Byrne has filed the necessary report with US Fish and Wildlife.

 

Jim Donahue has been in contact with Roger. Al will not be able to accompany him on the day of the weed treatment.  Jim has volunteered to assist.

 

The DNR has recently conducted a fish count. There are no results available.

 

Building Committee:

 

Due to the fact that there was no action taken by the Lake Diane Property Owners Association within a ten year period, the Hillsdale Court sided with the Duquette’s on the travel trailer suit. There is a statute of limitations of ten years to bring a non-compliant property owner into compliance with their deed restrictions.  Item 3 of the deed restrictions for the East Ten Acre subdivision states that “A travel trailer or motor home not in excess of 8 ft. X 40 ft. may be occupied on the premises during the summer months of the four years following purchase only.”  Duquettes purchased their property fourteen plus years ago, and immediately placed their travel trailer on their lot.  Therefore, they will be allowed to keep the travel trailer on the premises.  However, if the current travel trailer is removed from the lot, Duquette’s will not be permitted to return it, or replace it with another travel trailer.  Al will contact the county health department to address concerns regarding sewer and sanitation issues.

 

In order to bring non-compliant property owners into compliance, Jim will monitor travel trailers, then Lake Diane Property Owners Association will proceed as necessary. This action is a direct result of the majority of the Lake Diane property owners request to remove travel trailers.

 

Bob Pitzen reported that the Massey’s and the Southworth’s are interested in purchasing the Lake Diane park located on Jay Bay. Bob was advised to relay to them that the only way the park can be sold is if 51% of the Lake Diane property owners agree to the sale.  

 

Dan Fleck has plans to submit application to build a house with an attached storage facility on his lot on Horn Drive.

 

Dredging:

 

Nothing new to report.

 

Parks:

 

Nothing new to report on the shoreline restoration project.

 

The teeter totter at Chickadee Park has been repaired. The play structure was blown over and damaged in a storm.  Kevin and Terry Rupp will upright, then make necessary repairs.

 

The “NO WAKE” signs have arrived.

Lake Diane Events:

 

The jump house has been ordered for the family picnic.

 

Old Business:

 

Jerry Agrusa has volunteered to take over filings for past due accounts. Accounts with a past due balance of $1,000 or more will be pursued in court.

Pamela Esterline Beck has requested to speak at the annual meeting. She is running for Treasurer of Hillsdale County.  She will be given a small window to promote her candidacy.

The meeting was called to order by President Roger Giallorati at 10AM.

A quorum was verified.

 

Kim Byrne, Secretary presented minutes from the June 14, 2014 annual meeting. The minutes were approved as written.

 

Nominations were accepted for three vacant positions on the LDPOA Board of Trustees. Nominees were:

All candidates accepted their nominations.

 

Rod Anderson made a motion that the option for nomination be closed. Al Vitous seconded.  A vote was taken and the option for nominations closed.

 

Results of the election with number of votes received, and term length is:

 

Kim Byrne – 32, 3 years

Jerry Agrusa – 23, 2 years

Al Vitous – 22, 2 years

Ruth Weiss – 21

Bob Pitzen – 19

 

 

Aquatic Life:

 

The lake was treated for weeds June 3rd.  Al Vitous accompanied the lead boat with a map to indicate which areas were be treated.  It appears as the treatment was effective.  There is money available in the budget if a second spray is necessary.  Dave Ogle voiced concern that his shoreline was skipped two years in a row.  He was able to retrieve the operators with their equipment.  They then returned to treat his shoreline.  He then proposed a special assessment for weed treatment.  Roger indicated that the board had discussed that in the past, but concluded that it is not beneficial to the lake to be under the control of a separate entity.  Lily pads will be sprayed in the fall. 

 

There was a total of 37 goose eggs collected from two goose round-ups. Roger gave a presentation on “Goose Away” lights.  The lights will deter geese for a 75’ radius from the light.

 

Dr. Jo Latimer instructed seven volunteers from the lake in weed mapping. Arda Bucher presented a report of the findings.

 

Parks:

 

The teeter totter at Chickadee Park is in need of repair. Scott Preston purchased the equipment.  Kevin will check with him for the information on the manufacturer to make the necessary repair. 

 

Due to complaints of late night/early morning fishing by non-residents, there have been three “NO FISHING, NO SWIMMING” signs to be posted. One will be posted at the shelter house, one at Chickadee Park, and one at Pointe Dr.

 

Kevin gave a report on the findings of the dive on the island that surfaces on the north end of the lake in the late summer months. The island is made up of stumps which have been cabled together and submerged.  This was done when the lake was built. 

 

Terry Rupp gave a report on the shoreline restoration project. There has been a meeting with the DEQ to gather information for the application.  Tonight is a fundraiser titled “Motown Showdown”.  There is a golf outing scheduled for September 26th at Country Meadows golf course in Fremont, Indiana.

 

Lake Diane Events:

 

We are in need of volunteers for the Annual Picnic. A volunteer form is circulating during the meeting today to seeking volunteers for set-up, roasting the sweetcorn, and clean-up.

 

The fireworks are scheduled for July 4th, with a rain date of July 5th.

 

There is an ad running for the lake-wide garage sales. The banner is up.  Tari Sharp volunteered to make new vinyl numbers to update banner information.

 

The Johnson lawsuit is ongoing. Roger and Jim are being deposed June 23rd.  AAA has been released.

 

Dredging:

 

All estimates are outdated, and will be researched and obtained as the funding becomes available.

 

Treasurer’s Report:

 

Jim Watt, Treasurer presented the annual report. The report was approved as written.

 

The proposed 2016 annual budget was submitted. Al Vitous made a motion to pass the budget as proposed.  Jerry Agrusa seconded the motion. A vote was taken, and the motion passed unanimously.

 

Results of the 2015 audit were presented. The audit was completed by Arda Bucher, Ruth Weiss and Chris Hollenbeck.  The results were approved.  Next year’s committee volunteers are:  Mike Skaff, Rod Anderson, and Nancy Bell.

 

Dan Fleck voiced concern over inaccurate billing practices. It has been reported that some property owners have been billed incorrectly for their annual dues.  Jim will continue to research and correct the billing to insure accuracy.  Members are encouraged to contact Jim directly if they have a discrepancy in their annual billing.  

 

Old Business:

 

At last year’s annual meeting, it was proposed that a “Release of Information” be signed by Member’s giving permission for Lake Diane Property Owners Association to release information; primarily their address. The attorney has advised against this.

 

New Business:

 

Mike Skaff is present to discuss Lorna Jones house. The house is located adjacent to his property and is in complete disrepair.  There are rodents present, and the yard is not maintained.  Al will contact the Department of Health and the Hillsdale Building Authority to research a solution.

 

Due to numerous complaints about property owner’s utilizing trailers for long term use, members of the board met with the LDPOA attorney. Names and addresses will be passed to the attorney of property owners in violation.  In turn, the attorney will inform the property owners they are in violation then give them a time frame in which to comply.

 

There was question as to whether there are funds available for the repair of West Diane. The funds were being held by the township.  Roger indicated that there has been communication with the township treasurer, and the funds are depleted due to past repairs.

 

At 12:05PM Al Vitous made a motion to adjourn the meeting. Jerry Agrusa seconded the motion.  A vote was taken, and the meeting adjourned.

Treasurers Report:

 

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written.  Jim also provided the board members with an updated statement of past due accounts.

 

Aquatic Life:

 

There were six members in attendance for the goose egg and nest destruction class presented by the US Fish & Wildlife. The requirements for the permit are outdated as of this year.  A resolution signed by an elected official must be on file.  Roger and Jerry have been in contact with Amboy Township Supervisor, Brad Smith to bring the status of the condition up to date.  Upon satisfaction of the resolution, the association will be in compliance with the requirements.  The first goose egg roundup is tentatively scheduled for April 16th, with a second roundup April 30th.

 

Building Committee:

 

Jeff Sabo has received written permission from the DNR to install a dock on his property at Bear Point. There was question as to whether their installation of a dock would impede the channel causing a “No Wake Zone”.  The DNR has measured, and verified that there is adequate distance for two watercraft to pass while making wake.  Prior to installation of their dock, application must be made to Lake Diane Building Committee.

 

The lone non-compliant trailer owner on Easy Street continues to deny claims that they are in violation of their deed restrictions. Their claim is there was a break in chain of title, causing the deed restrictions to be ineffective for their property.   LDPOA attorney, Roy Brandes has verified through title search that there are deed restrictions in place, and the property owner’s are legally bound to conform.  There are dates scheduled for Discovery, Pre-Trial and Trial.

 

Application has been received for a storage barn at 14911 Woodbridge Rd.

 

 

 

Dredging:

 

Nothing new to report.

 

Parks:

 

Nothing new to report on the shoreline restoration project.

 

There is a broken weld on the teeter totter at Chickadee Park. Repair will be made as soon as possible.

Lake Diane Events:

 

The spring newsletter has gone out to members along with the schedule of events.

 

Jerry Agusa has volunteered to chair the annual picnic.

 

Old Business:

 

Ruth Weiss is not interested in pursuing past due accounts in small claims court.  Jerry Agrusa has volunteered to take over filings.  Accounts with a past due balance of $900 or more will be pursued.

 

New Business:

 

May’s LDPOA monthly board meeting has been rescheduled for May 21st.

The meeting was called to order by President Roger Giallorati at 10AM.

The Pledge of Allegiance was recited.

 

Kim Byrne, Secretary presented minutes from the January 16, 2016 monthly meeting.  The minutes were approved as written.

 

Treasurers Report:

 

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written.

 

Aquatic Life:

 

Aquatic Weed Control has been paid $800.00 to apply for the necessary permit from the DNR to treat the weeds in the lake for the 2016 season.

 

There are seven LDPOA members attending the goose nest destruction class offered by the DNR which is being held April 7 in Novi, Michigan.

 

 

 

Building Committee:

 

The owners of the camper trailer on Easy Street have secured an attorney. They deny the allegation they are in violation of their deed restrictions.  Roger will schedule an appointment with Roy Brandes to discuss moving forward with the case. 

 

Dredging:

 

Nothing new to report.

 

Parks:

 

Kevin has gathered information on the soft landing material (shredded rubber) that will potentially be placed under the donated playground equipment at Chickadee Park. He was unable to speak with the company the structure is coming from, but was able to gather information via the Internet.  His best estimate is that it would cost roughly $800 for adequate coverage and protection.  There are negative reviews on the product itself.  After discussion, it was decided that pea gravel with a treated lumber border will be a better option.

There is nothing new to report on the shoreline restoration project.

There is a conflict with the scheduling of the car show Labor Day weekend. Roger will contact Fred Lietzke and Gary Beale to discuss.

 

Old Business:

 

Kim Byrne read a letter from Cyndee Gochanour, Hillsdale County Toys for Tots Director, commending Lake Diane for their generous donation to Toys for Tots.

 

New Business:

 

Roger has composed a spring newsletter to include with the annual billing. The newsletter will indicate if dues are not paid prior to May 15, parcel owners will not receive weed treatment of their shoreline.
