The meeting was called to order by President Roger Giallorati at 10AM.

 

Board Members in Attendance:

The Pledge of Allegiance was recited.

 

A quorum was verified.

 

Kim Byrne, Secretary presented minutes from the June 14, 2014 annual meeting. The minutes were approved as written.

 

Nominations were accepted for three vacant positions on the LDPOA Board of Trustees. Nominees were:

 

Jerry Agrusa

Al Vitous

Kim Byrne

Bob Pitzen

Ruth Weiss

 

All candidates accepted their nominations.

 

Rod Anderson made a motion that the option for nomination be closed. Al Vitous seconded.  A vote was taken and the option for nominations closed.

 

Results of the election with number of votes received, and term length is:

 

Kim Byrne – 32, 3 years

Jerry Agrusa – 23, 2 years

Al Vitous – 22, 2 years

Ruth Weiss – 21

Bob Pitzen – 19

 

 

Aquatic Life:

 

The lake was treated for weeds June 3rd.  Al Vitous accompanied the lead boat with a map to indicate which areas were be treated.  It appears as the treatment was effective.  There is money available in the budget if a second spray is necessary.  Dave Ogle voiced concern that his shoreline was skipped two years in a row.  He was able to retrieve the operators with their equipment.  They then returned to treat his shoreline.  He then proposed a special assessment for weed treatment.  Roger indicated that the board had discussed that in the past, but concluded that it is not beneficial to the lake to be under the control of a separate entity.  Lily pads will be sprayed in the fall. 

 

There was a total of 37 goose eggs collected from two goose round-ups. Roger gave a presentation on “Goose Away” lights.  The lights will deter geese for a 75’ radius from the light.

 

Dr. Jo Latimer instructed seven volunteers from the lake in weed mapping. Arda Bucher presented a report of the findings.

 

Parks:

 

The teeter totter at Chickadee Park is in need of repair. Scott Preston purchased the equipment.  Kevin will check with him for the information on the manufacturer to make the necessary repair. 

 

Due to complaints of late night/early morning fishing by non-residents, there have been three “NO FISHING, NO SWIMMING” signs to be posted. One will be posted at the shelter house, one at Chickadee Park, and one at Pointe Dr.

 

Kevin gave a report on the findings of the dive on the island that surfaces on the north end of the lake in the late summer months. The island is made up of stumps which have been cabled together and submerged.  This was done when the lake was built. 

 

Terry Rupp gave a report on the shoreline restoration project. There has been a meeting with the DEQ to gather information for the application.  Tonight is a fundraiser titled “Motown Showdown”.  There is a golf outing scheduled for September 26th at Country Meadows golf course in Fremont, Indiana.

 

Lake Diane Events:

 

We are in need of volunteers for the Annual Picnic. A volunteer form is circulating during the meeting today to seeking volunteers for set-up, roasting the sweetcorn, and clean-up.

 

The fireworks are scheduled for July 4th, with a rain date of July 5th.

 

There is an ad running for the lake-wide garage sales. The banner is up.  Tari Sharp volunteered to make new vinyl numbers to update banner information.

 

The Johnson lawsuit is ongoing. Roger and Jim are being deposed June 23rd.  AAA has been released.

 

Dredging:

 

All estimates are outdated, and will be researched and obtained as the funding becomes available.

 

Treasurer’s Report:

 

Jim Watt, Treasurer presented the annual report. The report was approved as written.

 

The proposed 2016 annual budget was submitted. Al Vitous made a motion to pass the budget as proposed.  Jerry Agrusa seconded the motion. A vote was taken, and the motion passed unanimously.

 

Results of the 2015 audit were presented. The audit was completed by Arda Bucher, Ruth Weiss and Chris Hollenbeck.  The results were approved.  Next year’s committee volunteers are:  Mike Skaff, Rod Anderson, and Nancy Bell.

 

Dan Fleck voiced concern over inaccurate billing practices. It has been reported that some property owners have been billed incorrectly for their annual dues.  Jim will continue to research and correct the billing to insure accuracy.  Members are encouraged to contact Jim directly if they have a discrepancy in their annual billing.  

 

Old Business:

 

At last year’s annual meeting, it was proposed that a “Release of Information” be signed by Member’s giving permission for Lake Diane Property Owners Association to release information; primarily their address. The attorney has advised against this.

 

New Business:

 

Mike Skaff is present to discuss Lorna Jones house. The house is located adjacent to his property and is in complete disrepair.  There are rodents present, and the yard is not maintained.  Al will contact the Department of Health and the Hillsdale Building Authority to research a solution.

 

Due to numerous complaints about property owner’s utilizing trailers for long term use, members of the board met with the LDPOA attorney. Names and addresses will be passed to the attorney of property owners in violation.  In turn, the attorney will inform the property owners they are in violation then give them a time frame in which to comply.

 

There was question as to whether there are funds available for the repair of West Diane. The funds were being held by the township.  Roger indicated that there has been communication with the township treasurer, and the funds are depleted due to past repairs.

 

At 12:05PM Al Vitous made a motion to adjourn the meeting. Jerry Agrusa seconded the motion.  A vote was taken, and the meeting adjourned.

Kim Byrne, Secretary presented minutes from the March 5, 2016 monthly meeting. The minutes were approved as written.

 

Treasurers Report:

 

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written.  Jim also provided the board members with an updated statement of past due accounts.

 

Aquatic Life:

 

There were six members in attendance for the goose egg and nest destruction class presented by the US Fish & Wildlife. The requirements for the permit are outdated as of this year.  A resolution signed by an elected official must be on file.  Roger and Jerry have been in contact with Amboy Township Supervisor, Brad Smith to bring the status of the condition up to date.  Upon satisfaction of the resolution, the association will be in compliance with the requirements.  The first goose egg roundup is tentatively scheduled for April 16th, with a second roundup April 30th.

 

Building Committee:

 

Jeff Sabo has received written permission from the DNR to install a dock on his property at Bear Point. There was question as to whether their installation of a dock would impede the channel causing a “No Wake Zone”.  The DNR has measured, and verified that there is adequate distance for two watercraft to pass while making wake.  Prior to installation of their dock, application must be made to Lake Diane Building Committee.

 

The lone non-compliant trailer owner on Easy Street continues to deny claims that they are in violation of their deed restrictions. Their claim is there was a break in chain of title, causing the deed restrictions to be ineffective for their property.   LDPOA attorney, Roy Brandes has verified through title search that there are deed restrictions in place, and the property owner’s are legally bound to conform.  There are dates scheduled for Discovery, Pre-Trial and Trial.

 

Application has been received for a storage barn at 14911 Woodbridge Rd.

 

 

 

Dredging:

 

Nothing new to report.

 

Parks:

 

Nothing new to report on the shoreline restoration project.

 

There is a broken weld on the teeter totter at Chickadee Park. Repair will be made as soon as possible.

Lake Diane Events:

 

The spring newsletter has gone out to members along with the schedule of events.

 

Jerry Agusa has volunteered to chair the annual picnic.

 

Old Business:

 

Ruth Weiss is not interested in pursuing past due accounts in small claims court.  Jerry Agrusa has volunteered to take over filings.  Accounts with a past due balance of $900 or more will be pursued.

 

New Business:

 

May’s LDPOA monthly board meeting has been rescheduled for May 21st.

Aquatic Life:

 

Aquatic Weed Control has been paid $800.00 to apply for the necessary permit from the DNR to treat the weeds in the lake for the 2016 season.

 

There are seven LDPOA members attending the goose nest destruction class offered by the DNR which is being held April 7 in Novi, Michigan.

 

 

 

Building Committee:

 

The owners of the camper trailer on Easy Street have secured an attorney. They deny the allegation they are in violation of their deed restrictions.  Roger will schedule an appointment with Roy Brandes to discuss moving forward with the case. 

 

Dredging:

 

Nothing new to report.

 

Parks:

 

Kevin has gathered information on the soft landing material (shredded rubber) that will potentially be placed under the donated playground equipment at Chickadee Park. He was unable to speak with the company the structure is coming from, but was able to gather information via the Internet.  His best estimate is that it would cost roughly $800 for adequate coverage and protection.  There are negative reviews on the product itself.  After discussion, it was decided that pea gravel with a treated lumber border will be a better option.

There is nothing new to report on the shoreline restoration project.

Lake Diane Events:

 

There is a conflict with the scheduling of the car show Labor Day weekend. Roger will contact Fred Lietzke and Gary Beale to discuss.

 

Old Business:

 

Kim Byrne read a letter from Cyndee Gochanour, Hillsdale County Toys for Tots Director, commending Lake Diane for their generous donation to Toys for Tots.

 

New Business:

 

Roger has composed a spring newsletter to include with the annual billing. The newsletter will indicate if dues are not paid prior to May 15, parcel owners will not receive weed treatment of their shoreline.

Aquatic Life:

 

Aquatic Weed Control has requested $800.00 to apply for the necessary permit from the DNR to treat the weeds in the lake for the 2016 season. Due to the fact that; (1) there are so few options, (2) the bid from Scott Banfield was comparable to Aquatic Weed Control, and (3) Aquatic Weed Control communicates professionally, and Scott Banfield does not, Roger made a motion that the bid from Aquatic Weed Control be accepted for weed treatment of Lake Diane for 2016.  Jim seconded the motion.  A vote was taken, and the motion passed unanimously.

 

Building Committee:

 

All but one camper trailer have been removed. A registered letter has been sent to the property owner from Roy Brandes, Attorney for LDPOA.  We have not yet heard if there has been confirmation of receipt.

 

The house at 14242 West Diane has been demolished, and the debris removed from the site.

.

Dredging:

 

Nothing new to report.

 

Parks:

 

Kevin has gathered information on the soft landing material that will be placed under the donated playground equipment at Chickadee Park. There is still a question on the cost of the material.   Kevin will gather that information, then present his findings at the next meeting.  At that time, the board will make a decision on who will bear the cost of the material and installation.

Lake Diane Events:

 

The Calendar of Events for 2016 was presented and approved.

 

Old Business:

 

Ruth Weiss has volunteered to be our representative in small claims court. She will represent LDPOA to pursue accounts that are in arrears $1,000.00 or more.  There are currently eight accounts with an unpaid balance of $1,000.00 or more.

 

New Business:

 

The February, 2016 LDPOA meeting will be canceled.

Aquatic Life:

 

Roger has asked Scott Banfield for a bid for 2016 weed control treatment of Lake Diane. Mr. Banfield has not yet submitted his proposal.  A decision will be made prior to March 1st how to proceed.  Licensed aquatic weed treatment companies are not common, which creates limited options.

 

Weed mapping will be done in the spring of 2016. It has been suggested that the end of May would produce the most accurate results.  Dan Fleck has volunteered to assist Arda Bucher.

 

Roger plans to sign up for the goose egg round-up course through the DNR. Only class participant’s applications are approved for permits.

Building Committee:

 

All but one camper trailer have been removed. Jim Watt made a motion to instruct Lake Diane Property Owners Association attorney, Roy Brandes, to proceed with legal action to bring the property owner into compliance with their deed restrictions.  Terry seconded the motion.  A vote was taken, and the motion passed unanimously.  Roger will schedule an appointment as soon as possible.

 

There has been no progress in the removal of the condemned structure at 14242 West Diane. Contact will be made to discuss timing with Larry Hinkle, as he has been contracted by the homeowner to demolish the structure, and remove the debris.

 

Al is concerned about the condition of Blaine LeBlanc’s house at the north end of the lake. He has spoken to the Hillsdale County Building Authority regarding the potential for mold infestation.  LDPOA will “hand-off” the potential situation to the Hillsdale County Building Authority.  Al has also discussed the shipping container that is being used for storage at the corners of Woodbridge and Territorial Roads with the Hillsdale County Building Authority.  They will not respond to the complaint because it is not a habitable structure.

 

Bob Pitzen submitted approved plans for an addition and deck at 1848 Anchor Way to the secretary for filing.

 

Dredging:

 

Nothing new to report.

 

Parks:

 

Terry Rupp would like to schedule a work day for cleanup in the spring at the shelter house. To date, there has been $9,100.00 in donations toward the shoreline restoration. We are only $1,900.00 away from our goal.

 

Kevin has looked into a soft landing material for the proposed playground equipment at Chickadee Park. There is a mulch-like rubber material manufactured, along with a border that is used for containment available.

Lake Diane Events:

 

The Toys for Tots Breakfast with Santa event was held prior to the meeting today. Thank you to all who participated!!

 

Old Business:

 

The board is ready to move forward with proceedings on past due accounts. Small claims court will be the most cost efficient way to collect.  

 

New Business:

 

Jim Watt asked if the board will be accepting bids for park lawn maintenance. The topic was discussed, and the board agreed it will be best if Dave Hintz continues to provide his services.

Kim Byrne, Secretary presented minutes from the October 17, 2015 monthly meeting.  The minutes were approved as written.

Treasurers Report:

Jim Watt, Treasurer presented the Treasurer’s Report.  The report was approved as written.

Aquatic Life:

Roger spoke with Aquatic Weed Control regarding the extent of the shoreline that was treated in the spring of this year.  Aquatic Weed Control treated from the shoreline out 100’.  Roger suggested treating from the shoreline out 50’, to reduce cost.  He was told that the same amount of chemical would be used if the treatment were 100’ or 50’ from shore due to the drifting of the chemical.   Roger continues to seek alternate sources and estimates for the 2016 season.  He has spoken to Scott Banfield, and his cost per acre is substantially higher than Aquatic Weed Control.  A decision will have to be made by late February, 2016.

Building Committee:

All but one camper trailer have been removed.  The owner of that camper trailer has received notice that further action will be taken to enforce compliance with their subdivision covenants. 

The homeowner at the address of 14242 West Diane has been in touch with Al and Roger regarding the scheduling of the demolishment of the condemned structure.  She indicated that the contractor will begin demolishing in approximately 14 days.

Al is concerned about the condition of Blaine LeBlanc’s house at the north end of the lake.  He has noted mold on the exterior which could be an indication of mold on the interior, as well.  He will speak to Marty at the Hillsdale County Building Authority regarding this potential issue.

Jeff and Amy Sabin have contacted roger regarding dock placement at their home on Bear Pointe.  Roger shared with them the map which was initially provided by the Hillsdale County Sheriff’s Department.  The Sabin’s will contact Hillsdale County Sheriff’s Department to proceed.

There was discussion regarding the pod/shipping container like storage facility being used at the home on the corner of Woodbridge Rd. and Territorial Rd.  Al will speak to Marty at the Hillsdale County Building Authority regarding this issue, then will report back to the board his findings.

Dredging:

Nothing new to report.

Parks:

Jo Ellen Wright submitted plans to the board for playground equipment she would like to donate for placement at Chickadee Park.  It was noted during discussion amongst the board that safe landing material was not on the plans, and would have to be added, otherwise the plans are acceptable.  Jim Watt made a motion the Lake Diane Property Owners Association accept the donation of the playground equipment with the addition of soft landing material.  Jerry Agrusa seconded the motion and the motion passed unanimously.

Terry Rupp gave an update of the shoreline restoration project.  Funds of approximately $3,000 are still needed to complete the project.  The DEQ has approved the application.  Application must also be made to Hillsdale County Road Commission for approval.

Welcome Committee:

Nothing new to report.  Al will pass along packets to Jim, as Al will be out of town for an extended period.

Lake Diane Events:

Toys for Tots Breakfast with Santa is scheduled for December 5th from 10AM to Noon.  Plans are proceeding nicely with the addition of face painting this year. 

Old Business:

Due to the fact that LDPOA is organized under the Summer Resort Act, it was determined that the association is liable for collection costs on past due accounts.  The board is planning to pursue all accounts with an outstanding balance $1,000.00 or greater.

Kim will order “No Wake” signs in the spring for placement.

New Business:

Nothing new to report.

The meeting was called to order by President Roger Giallorati at 10:05 AM.

Kim Byrne, Secretary presented the minutes from the May 17, 2014 meeting. The minutes were approved as written.

Treasurers Report:

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written.

Aquatic Life:

Weed spraying took place in June. In general, everyone is happy with the results. The lily pads will be sprayed late September. Roger explained that only 40% of each “group” of lily pads can be sprayed, but if a waterway is clogged, 100% of the clog can be sprayed.

Dr. Jo Lattimore will be performing lake mapping May 28-29, 2015. Volunteers will be sought for assistance and education. There is no charge for this service. Roger also indicated that the depth of the lake will also be mapped. Dr. Lattimore has requested a topographical map.

We will also need volunteers to attend the Michigan Lake & Stream conference April, 2015.

Building Committee:

Marty from the Hillsdale County Building Authority is aware of non-conforming lots. Al reported that property owners are gathering necessary information from him indicating they will be building a structure less than 200 square feet. When, in fact, their structures turn out to be larger and more complex than originally indicated. Al will continue to monitor and follow-up on this situation. He will then report back to the board.

Roger discussed the Variance Resolution that was passed approximately one year ago. He would like to suspend the resolution while he verifies the ability to make lots that are not touching contiguous. There is concern that pole barns will be constructed “everywhere”. In the past, variance applicants were granted permission to construct storage buildings on lots that were on the corners, sides or across the road from their lakefront lot. After discussion, Roger made a motion to: Temporarily suspend the variance resolution until we investigate with the attorney making lots contiguous that are not touching. Jim Watt seconded the motion. A vote was taken. The motion passed unanimously.

Dredging:

Today will be the special meeting to tabulate votes by Members for an increase in annual dues from $50 per lot to $120 for owner’s first lot, then $50 for every lot thereafter. There are enough votes to pass the resolution. Roger reported that dredging should begin in approximately two years. Members will decide as a group which area will be dredged first.

Parks:

Kevin placed the required type buoys to mark the hazardous areas in the lake. Since water depth has decreased buoys are beginning to lean.

The island has not surfaced on the north end of the lake. Kevin has spoken to a biologist about the island. He reported that the island will surface when the water reaches a certain temperature. The island is made up of stumps and branches tied together to create a fish habitat. It has stayed on the floor of the lake for 30-40 years.

Terry Rupp gave a report on the shoreline restoration effort. There will be a committee meeting after today’s monthly meeting.

Lake Diane Events:

Today is the Annual Family Picnic. Thank you to all volunteers who help make this a successful event!

Old Business:

There is no update on the potential for a cellular tower.

The board discussed term length for the trustees who remain in position by election from the 2014 annual meeting. There is one-three year position, and two-two year positions. The trustees are Terry Zibbel, Roger Giallorati, and Jim Watt. Since all three trustees were the only three nominees, terms lengths will be decided prior to the next monthly meeting, then reported to the board. The following terms are due at the annual meeting, 2015: Jerry Agrusa, Al Vitous, and Kim Byrne.

Roger asked for volunteers to actively seek candidates for next year’s election for the

LDPOA Board. Kim Byrne and Terry Rupp volunteered.

New Business:

At 10:52AM, Roger suspended the monthly meeting to open the Special Meeting.

At 10:59AM, Roger re-opened the monthly meeting.

Al voiced his concern over the run-down house on West Diane. He reported that there are rodents in and out of the property and the lawn is no longer being maintained by the property owner. A discussion ensued, then it was decided that Roger will contact the attorney to discuss blight. Al will contact the Hillsdale County Building Authority. A report will be given at next month’s monthly meeting.

There have been multiple complaints of unsafe boating. Anyone witnessing unsafe or illegal boating is encouraged to call 911.

At 11:18AM, Al made a motion that the meeting be adjourned. Jim seconded the motion. A vote was taken, and the meeting adjourned.

Monthly Board Meeting

April 12, 2014

The meeting was called to order by President Roger Giallorati at 10:00 AM.

The Pledge of Allegiance was recited.

Kim Byrne, Secretary read the minutes from the March 8, 2014 meeting. The minutes were approved as written.

Treasurers Report:

Jim Watt, Treasurer presented the Treasurer’s Report. The report was approved as written.

Aquatic Life:

The date for the goose egg/nest destruction has yet to be verified. Roger will contact Dan Fleck to confirm date(s).

Dan Fleck has received water sampling materials. He will conduct the spring phosphorus test then deliver the sample to DEQ.

Weed spraying will be done after the lake mapping which is scheduled to be done May, 2014. Permission slips will be good for one more year.

Building Committee:

Nothing new to report.

Bylaws:

Bylaws were prepared and mailed to all Members immediately following the March 8, 2014 monthly meeting.

Dredging:

Roger has prepared a letter for presentation to the LDPOA Members regarding the need for an increase in dues for review by the board. The board will meet April 26, 2014 to prepare letter for mailing to members.

Parks:

Nothing new to report.

Welcome Committee:

Nothing new to report.

Lake Diane Events:

Nothing new to report.

Old Business:

Kathy Christ, Kristine Hollenbeck, and Ruth Weiss have volunteered to review the accounting records of 2013. The report will be presented at the May monthly board meeting.

New Business:

Bob Christ is a member of Lakeview Church. The church is in hosting a golf outing. Bob asked if the board would be interested in sponsoring a team or hole for the outing since the church provides space for our boater’s safety course. It was decided that each member, along with Bob Christ and Larry Weiss, will contribute personal funds to sponsor a hole for the outing.

Kathy Agrusa and Karen Watt have volunteered to organize an electric boat parade July 4th. Roger made a motion that this be a sponsored lake event if there are no liability implications for the LDPOA. Jerry Agrusa seconded the motion. The motion passed unanimously. Jim Watt will verify that there is no liability implications for LDPOA.

At 10:46AM, Roger made a motion that the meeting be adjourned. Jim seconded the motion. A vote was taken, and the meeting adjourned.
